Terms of Service

1. Agreement
USTourGuide is operated by Front Window Labs ("we," "us"). These terms cover the USTourGuide mobile app, the ustourguide.app websites, and our publishing tools and portal (together, "the services") — and they apply to everyone who uses them: travelers, organizations, and publishers. By downloading, accessing, or using the services, you agree to these terms. If you do not agree, do not use the services.
2. The app is free for travelers
We do not charge travelers to use the app or take tours. Publishing a tour for other people, or listing a tour in the public directory, requires a paid plan or an Event Pass, as described below. Organizations and publishers control how they share access to tours they are allowed to publish — for example, through links and QR codes — and any arrangements they make with their own visitors are between them and their visitors.
3. Plans and publishing
Plans currently offered:
- Free — $0. Create up to 3 personal tours in the USTourGuide app for use on your own phone. Free does not include the web portal, public directory listing, or publishing for other people.
- Event Pass — $24 one-time, in U.S. dollars, good for 30 days. One shareable tour with a link and QR code. Event Pass is not a subscription and does not include the web portal or an ongoing directory listing. When the 30 days end, the pass ends.
- Creator — $19 per month or $190 per year. For an individual or organization. Up to 3 published tours. Web portal included.
- Professional — $39 per month or $390 per year. For an individual or organization. Up to 15 published tours, team access, and priority support. Web portal included.
- Destination — custom pricing, arranged with us. High-volume publishing, multi-organization coordination, and onboarding support.
Live prices and plan descriptions are posted at ustourguide.app/#pricing. If a subscription price changes, the new price takes effect at your next renewal, not mid-term.
Public listing in the USTourGuide directory is included with paid subscription plans (Creator, Professional, and Destination), subject to our review and approval.
Tours published under an organization account belong to that organization account. Personal Free tours belong to the person who created them on their own device. Team access, where a plan includes it, does not transfer an organization's tours to a departing individual's personal account.
4. Payments, renewal, and cancellation
You may pay on the web through Stripe, or in the iOS app through Apple In-App Purchase. Card payments on the web are processed by Stripe; card details do not touch our servers. Apple In-App Purchases are billed by Apple to the Apple ID you use on the device.
Creator and Professional subscriptions renew automatically at the end of each monthly or yearly period until you cancel. Destination billing is by arrangement. Event Pass is a one-time purchase and does not renew.
You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period; you keep access until then. If you subscribed through Apple, cancel in that Apple ID's Subscriptions settings. If you subscribed on the web, cancel as described in our Cancellation & Refunds policy.
Refunds for web (Stripe) subscriptions follow that same Cancellation & Refunds page. Refunds and cancellations for Apple In-App Purchases are handled by Apple under Apple's terms. This terms page does not change Apple's rules.
5. Content accuracy and access — please read this one
Content on the services — stories, descriptions, historical claims, and map locations — comes from many sources and may be inaccurate, incomplete, outdated, or misplaced. Locations may be marked in the wrong spot. And a place appearing in the app does not mean it is public property or open to visitors: many featured locations are on or near private land, restricted areas, or places with limited hours or no public access. You are responsible for confirming that you may lawfully and safely visit any location, for respecting private property and posted signs, and for obeying all laws. Never enter private property without permission.
6. Location features and safety
Tours and stops use your device's location to play content near you. Stay aware of your surroundings; never interact with the app while driving; obey all traffic laws, posted signs, and property boundaries. Tours describe places — they are not navigation, safety, or emergency guidance, and content about any facility supplements, never replaces, that facility's own official information.
7. Publisher content and your responsibility for it
When you create and publish tours, stops, or other material — including text, photographs, images, audio, video, and anything else you submit ("your content") — you promise that you have the legal right to publish it: it is your own original work, or you have permission or a license to use it, or it is otherwise lawfully available for your use. Do not publish other people's tours, writing, photographs, or recordings as your own. You are responsible for your content, including its accuracy and its lawfulness, and if a claim is brought against us because your content infringed someone else's rights or broke the law, you agree to cover the costs and damages that claim causes us.
8. You own your content; you give us a license to use it
You own your content. By publishing on USTourGuide, you grant Front Window Labs a perpetual, irrevocable, worldwide, royalty-free license to host, display, distribute, adapt, and reuse your content in any form within our services — including after a tour ends or an account closes. Deleting your account or a tour does not withdraw this license for content already published. This license is what lets us operate the services, keep shared history working, and build on published material over time.
9. The service as-is
The services are provided "as is" and "as available." Features may change, be interrupted, or be discontinued. To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement — including any warranty that content or locations are accurate — and our total liability for any claim relating to the services is limited to the amount you paid us in the twelve months before the claim arose.
10. Content standards, reports, and removal
You may not publish content that matches any of the following. These are yes/no checks on the submitted text, photos, audio, video, titles, and descriptions:
- Sexual activity, sexual posing, or sexual body exposure involving a person who is 17 or under, is described as 17 or under, or is depicted as a child.
- Sexual activity or genitals shown or described for sexual purposes (pornography), involving anyone.
- Step-by-step instructions to build a bomb, make a poison or illegal drug, or carry out a shooting, stabbing, or other violent crime.
- A statement that names a person or a group and tells the reader to kill, injure, or physically attack them.
- An offer to sell illegal drugs, illegal firearms, or stolen property, or to run a fraud or phishing scheme.
- Use of the name or logo of USTourGuide, Front Window Labs, Apple, or another real company to collect money, passwords, or account codes.
- Someone else's tour, writing, photograph, or recording published as yours.
- The same commercial advertisement posted as tour or stop content with no facts about a real, visitable place.
If you see content that matches the list above, email support@ustourguide.app with the tour or stop and what you saw. We review those reports. Our operational target is to finish that review within 24 hours of receiving the report. That 24-hour figure is an operational target, not a guarantee.
We may remove content that matches the list above, that violates the law, or that infringes someone else's rights. We may suspend or close accounts that publish that content. If we block a user or close an account, that block stands; sending another report or republishing the same material does not restore access.
If you believe content infringes your rights, contact us at the same address and we will review it.
11. AI-generated content
The website and portal may use AI to draft or polish tour text.
12. Restricted uses of the speech model
The narration voice is produced with a speech model licensed under the BigScience Open RAIL-M License (2022-08-18). As that license requires, you agree not to use the service or any narration produced through it for the restricted uses below. References to "the Model" or "Derivatives of the Model" in the list mean that speech model.
You agree not to use the Model or Derivatives of the Model:
- (a) In any way that violates any applicable national, federal, state, local or international law or regulation;
- (b) For the purpose of exploiting, harming or attempting to exploit or harm minors in any way;
- (c) To generate or disseminate verifiably false information and/or content with the purpose of harming others;
- (d) To generate or disseminate personal identifiable information that can be used to harm an individual;
- (e) To generate or disseminate information and/or content (e.g. images, code, posts, articles), and place the information and/or content in any context (e.g. bot generating tweets) without expressly and intelligibly disclaiming that the information and/or content is machine generated;
- (f) To defame, disparage or otherwise harass others;
- (g) To impersonate or attempt to impersonate (e.g. deepfakes) others without their consent;
- (h) For fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;
- (i) For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
- (j) To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;
- (k) For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;
- (l) To provide medical advice and medical results interpretation;
- (m) To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal relationships between assertions made in documents, indiscriminate and arbitrarily-targeted use).
13. Changes to these terms
We may update these terms as the services evolve. When we do, we will update the date above; continued use of the services after an update means you accept the revised terms.
